Warunki świadczenia usług
1. Scope
These Terms of Service apply to all orders placed through our online store.
2. Contract Partner
The purchase contract is concluded with:
Terrence Wern Yew Chong, trading as Kavva
Doggenriedstrasse 33
88250 Weingarten
terrence@kavva.co
3. Conclusion of Contract
The presentation of products in the online store does not constitute a legally binding offer, but an invitation to place an order.
By placing an order, you submit a binding offer to purchase. The contract is concluded when we accept your order by sending you an order confirmation email.
We reserve the right to refuse or cancel any order — for example, in cases of stock unavailability, pricing errors, suspected fraud, or delivery-location restrictions. If we cancel an order after payment has been taken, we will refund the full amount without delay.
4. Prices and Payment
Displayed prices include all taxes applicable to your delivery destination, as shown at checkout, plus any shipping costs.
Payment for the full order amount is due at the time you place your order — including for pre-orders, where the full price is charged at checkout regardless of the later dispatch date. See our Purchase Options Cancellation Policy for how pre-orders work.
If the applicable tax or duty rate changes between your order date and the dispatch date, we may adjust the amount charged accordingly, or notify you and offer you the option to cancel.
5. Shipping and Transfer of Risk
Estimated delivery times are shown on the product page and at checkout; for pre-orders, the expected dispatch window is shown on the product page, at checkout, and in your order confirmation.
We are not liable for delivery delays caused by shipping providers or customs authorities beyond our reasonable control.
For consumers, risk of accidental loss or damage during transit passes to you only upon delivery of the goods to you or a person designated by you — not upon handover to the carrier.
6. Retention of Title
The goods remain our property until full payment has been received.
7. Product Representation
We make every effort to present our products accurately. Colours, textures, and details may appear slightly different on your screen than in person, due to display settings and photography.
8. Right of Withdrawal
Consumers have a statutory right of withdrawal. Full details are in our Refund Policy. Pre-order customers may also cancel any time before dispatch for a full refund — see our Purchase Options Cancellation Policy.
9. Termination by Us
We may withdraw from the contract if you fail to make payment or accept delivery within a reasonable period, without prejudice to any other rights available to us.
10. Liability
We are liable without limitation for intent, gross negligence, injury to life, body, or health caused by us or our agents, and under the Product Liability Act (Produkthaftungsgesetz), where applicable.
For slight negligence, we are liable only for breach of essential contractual obligations (Kardinalpflichten) — obligations whose fulfilment enables proper performance of the contract and on which you may reasonably rely — and in that case our liability is limited to the foreseeable, contract-typical damage.
These limitations do not affect any statutory liability that cannot be excluded by agreement.
11. Warranty
Statutory warranty rights apply. For consumers, the warranty period is two years from delivery. Contact terrence@kavva.co for warranty claims.
12. Dispute Resolution
We are not obligated, and not willing, to participate in dispute resolution before a consumer arbitration board.
13. Amendments
We may update these Terms from time to time. The version in effect when you place your order applies to that order.
14. Jurisdiction
Consumers may bring proceedings against us in the courts of Germany or their own country of domicile; we may only bring proceedings against a consumer in their country of domicile.
15. Final Provisions
German law applies, excluding the CISG. This choice of law does not deprive consumers of protection under the mandatory provisions of their country of habitual residence. If any provision is invalid, the remainder stays in effect.
